1. Introduction
These Terms and Conditions ("Terms") govern your use of the IngaB. Photography website at ingaphoto.co.uk (the "Website") and the photography services provided by IngaB. Photography ("we", "us", or "our").
By accessing our Website or booking our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Website or services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Website. Your continued use of the Website or services constitutes acceptance of any modifications.
2. Services
2.1 Description of Services
IngaB. Photography provides professional photography services including, but not limited to:
- Wedding and engagement photography
- Family and portrait photography
- Newborn and maternity photography
- Corporate and business photography
- Event photography
- Product photography
2.2 Service Area
We are based in Manchester, UK, and primarily serve the North West of England. We are available for travel to other locations within the UK and internationally, subject to availability and additional travel fees.
3. Bookings and Payments
3.1 Booking Process
To book our services, please contact us via our Website, email, or phone. A booking is confirmed only when:
- We have agreed on the date, time, location, and scope of services
- You have signed a booking contract (where applicable)
- We have received the required deposit payment
3.2 Deposits
A non-refundable deposit is required to secure your booking date. The deposit amount varies by service type:
- Weddings: 30% of the total package price
- Other Sessions: 50% of the total session fee or a minimum of £50
The deposit secures your date exclusively and is non-refundable except in circumstances outlined in Section 4 (Cancellations and Rescheduling).
3.3 Payment Terms
- Weddings: The remaining balance is due no later than 14 days before the wedding date
- Other Sessions: The remaining balance is due on or before the session date
- Product Orders: Full payment is required before production and delivery
3.4 Payment Methods
We accept the following payment methods:
- Bank transfer (BACS)
- PayPal
- Card payments (via secure payment processor)
3.5 Late Payments
If the balance is not received by the due date, we reserve the right to cancel the booking without refund of the deposit. We may also charge interest on overdue amounts at 4% above the Bank of England base rate.
4. Cancellations and Rescheduling
4.1 Client Cancellations
If you need to cancel your booking, the following terms apply:
- More than 60 days before: Deposit forfeited; no additional charges
- 30-60 days before: 50% of the total fee is due
- Less than 30 days before: 100% of the total fee is due
4.2 Rescheduling
We understand that circumstances change. Rescheduling requests will be accommodated where possible, subject to the following:
- One free reschedule is permitted if requested more than 30 days before the original date
- Rescheduling requests made less than 30 days before may incur an administrative fee
- Rescheduled dates are subject to availability and must be within 12 months of the original date
4.3 Photographer Cancellation
In the unlikely event that we need to cancel your booking due to illness, emergency, or other unforeseen circumstances:
- We will make every effort to provide a suitable replacement photographer
- If no replacement is available, you will receive a full refund of all payments made
- Our liability is limited to the refund of payments made and does not extend to other losses or expenses
4.4 Force Majeure
Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or severe weather. In such cases, we will work together to reschedule or agree on a fair resolution.
5. Photography Sessions
5.1 Special Requests and Coverage
The Client understands and accepts that the photographic coverage will be as the Photographer's professional expertise determines. Special requests are not binding instructions, although every effort will be made to comply with the Client's wishes.
5.2 Session Duration
Session times are as agreed in your booking confirmation. We will endeavour to capture all the images discussed, but we cannot guarantee specific shots. Extended time beyond the agreed duration may incur additional charges.
5.3 Artistic Licence
The Photographer shall be granted artistic licence in relation to images captured and locations used, although every effort will be made to comply with the Client's wishes.
5.4 Client Responsibilities
You agree to:
- Arrive on time for your session
- Provide accurate information about locations, schedules, and any restrictions
- Obtain necessary permissions for private locations or venues
- Inform us of any specific shots or people that must be photographed
- Ensure all participants are aware of and consent to being photographed
5.5 Location and Venue Access
It is your responsibility to ensure we have appropriate access to locations and venues. Any fees required by venues (e.g., photography permits) are your responsibility unless otherwise agreed in writing.
5.6 Weather and Outdoor Sessions
For outdoor sessions, we will monitor weather conditions and may suggest rescheduling if conditions are unsuitable. Light rain or overcast skies are generally not grounds for rescheduling. The final decision to proceed rests with you.
6. Image Delivery
6.1 Delivery Method
Images will be supplied in full resolution via a private online gallery for you to download. All images will be digitally edited and in most cases enhanced, a service that is included in the cost of the photography package.
6.2 Delivery Timeframes
We aim to deliver your images within the following timeframes from the session date:
- Portrait/Family Sessions: 2-3 weeks
- Weddings: 8-12 weeks
- Events: 2-4 weeks
- Commercial/Product: As agreed in the brief
These are estimated timeframes and may vary during busy periods. We will keep you informed of any delays.
6.3 Number of Images
The approximate number of final edited images is specified in your package or quote. The actual number may vary based on the session and is at our professional discretion.
6.4 Editing and Style
All images are professionally edited according to our signature style. We do not provide unedited RAW files. Extensive retouching (e.g., body modifications, background replacements) is available for an additional fee.
6.5 Digital Files
Digital files remain the property of the Photographer. You are granted a licence to use the delivered files as outlined in these Terms.
6.6 Image Storage
We store your high-resolution images for a minimum of 2 years from delivery. After this period, we may delete files without notice. We recommend backing up your images immediately upon receipt.
7. Copyright and Usage Rights
7.1 Ownership
All photographs remain the intellectual property and copyright of IngaB. Photography. By commissioning our services, you receive a licence to use the images as outlined below.
7.2 Client Licence
Upon full payment, you are granted a non-exclusive licence to:
- Make copies of the images for friends and family
- Make unlimited prints for personal use
- Upload images to websites such as Facebook, Instagram, Twitter, or personal websites and blogs
- Use images in personal communications
You may NOT:
- Sell any imagery to third parties - full copyright remains with the Photographer
- Licence or commercially exploit the images without a commercial licence
- Submit images to competitions or publications without our consent
- Remove watermarks or alter images in a way that misrepresents the work
- Use images for any illegal or defamatory purpose
7.3 Commercial Licence
For commercial use (advertising, marketing, products for resale), a separate commercial licence must be purchased. Please contact us for commercial licensing enquiries.
7.4 Photographer's Usage Rights
Unless otherwise agreed in writing, we reserve the right to use images from your session for:
- Portfolio display (website, social media, print)
- Marketing and advertising materials
- Competition entries
- Educational purposes and demonstrations
If you do not wish your images to be used for these purposes, please inform us in writing before the session. An additional fee may apply for full privacy.
7.5 Credit and Attribution
When sharing images online or in print, we appreciate credit to "IngaB. Photography" or @ingab.photo, though this is not required for personal use.
8. Liability
8.1 Limitation of Liability
Our total liability for any claim arising from our services is limited to the total amount paid for those services. We are not liable for:
- Indirect, consequential, or incidental damages
- Loss of profits, data, or opportunities
- Events beyond our control affecting the quality or completion of services
8.2 Equipment Failure
We use professional equipment with backups. In the rare event of equipment failure resulting in loss of images, our liability is limited to a refund of fees paid. We maintain professional indemnity insurance for additional protection.
8.3 Image Expectations
Photography is inherently subjective. We cannot guarantee that all expectations will be met. We work to our professional standard and artistic vision. If you have specific requirements, please discuss them before the session.
8.4 Third-Party Actions
We are not responsible for actions of third parties (guests, venue staff, etc.) that may affect the photography. This includes obstruction of views, poor lighting decisions by venues, or interference with posed photographs.
9. Complaints and Disputes
9.1 Complaints Process
Any complaints should be raised by the Client with the Photographer in writing within 21 days of receipt of the images. We will work with you to understand and address your concerns.
9.2 Resolution
We are committed to resolving complaints fairly. Depending on the circumstances, resolutions may include:
- Re-editing of images to address specific concerns
- Partial refund where services fell short of agreed standards
- Complimentary additional session (at our discretion)
9.3 Mediation
If we cannot resolve a dispute directly, both parties agree to attempt mediation before pursuing legal action.
10. Website Terms
10.1 Website Use
You may use our Website for lawful purposes only. You agree not to:
- Use the Website in any way that violates applicable laws
- Attempt to gain unauthorised access to our systems
- Interfere with the proper functioning of the Website
- Copy, reproduce, or distribute any content without permission
10.2 Website Content
All content on our Website, including text, images, graphics, and logos, is our property or used with permission. Unauthorised use of any content may violate copyright, trademark, and other laws.

12.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.4 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12.5 Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any successor or affiliate.
